Abstract
In this decision by the Supreme Court to uphold the controversial “must-carry” rules that require cable systems to carry all local broadcast television stations in their market, the Court emphasized the need to preserve local broadcasters. However, there was much disagreement among the Justices (the rules were upheld by a 5-4 margin) about whether the rules were in fact content neutral – a debate that ultimately raises the question of whether local broadcasters need to be protected and made widely available because of the extent to which they perform differently than cable in terms of providing content that addresses local interests and concerns.
